About the Moot Proposition

The problem, Azad Digital Foundation & Ors. v. State of Vayuvana & Ors., was set in a fictional State. It combined a writ petition under Article 226 of the Constitution with a criminal miscellaneous petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The dispute arose from an adult satire show, a viral clip taken from it, and an AI-manipulated version of that clip. The State responded with an emergency takedown communication, an FIR and an arrest. The issues covered maintainability, intermediary liability under the Information Technology Act, 2000, protection of satire under Article 19(1)(a), and the legality of the criminal process.

Team’s Reflection

“This moot challenged us to balance free speech against the real harms of synthetic media, and no side of the problem was easy. Preparing for it taught us to build arguments from first principles and to defend them under tough questioning from the bench. We are thankful to our faculty, mentors and the organisers for a well-run competition, and we are glad to have represented our university.”
