Writ of mandamus cannot be issued directing all the COVID Victims to be compensated: Madras HC

The Hon’ble Madras High Court while hearing to various petitioners who filed the petition before the Hon’ble High Court seeking compensation to the kith and kin of the people who died due to Covid-19 virus remarked that the Hon’ble Court cannot issue the Writ of mandamus directing all the Covid Victims to be compensated. 

The Hon’ble Bench of the Hon’ble Chief Justice Sanjib Banerjee and Hon’ble Justice Senthil Kumar Ramamoorthy in the instant issue stated that it is the state who has the right to decide in this matter whether to pay compensation or not and if to pay then how much. This is a matter which is exclusively in the domain of the state. 

In the due course, the Hon’ble court also dealt with another plea wherein the petitioner seeks compensation for adequate and requirements and for providing other reliefs to-

  • Kith and kins of Covid-19 dead family.
  • To the welfare of children of parents who succumbed to Covid pandemic death.

Subsequently, the Hon’ble court after hearing the petitioners stated that the state can only decide when it is a matter of policy and extending relief, to persons affected by any calamity or so.

Furthermore, the Hon’ble court also observed that several schemes have already been put in place at both state and central levels to provide relief to a certain class of people either by way of food or financial assistance.
