Supreme Court rescued Gehna Vashisht, Stay on Bombay High Court Order

The Supreme Court on Wednesday provided relief to Gehna Vashisht by staying the order of the Bombay High Court. The Bombay High Court rejected the anticipatory plea of the actress concerning the porn film case. 

The bench headed by Justice Sanjay Kishan Kaul and BR Gavai ordered that there is no need to arrest Gehna Vashisht in the third FIR however she can join in the investigation as and when required. 

The counsel Adv. Ajit Wagh on the behalf of Vashisht argued that the prosecution need custody to turn up all the pornography rackets. He also argued, “The First FIR was based on a tip received. Yasmin was caught. Larger investigation going on. The police found that the petitioner was a friend of Yasmin. Gehana has been in custody for 133 days. Charge-sheet has been filed in the first FIR. Material is all the same.” 

Vahisht moved to S.C. against the FIR registered under Section 354C, 292, 293 of Indian Penal Code and Section 66E, 67,67A of Information technology Act. An anticipatory bail application was processed in the apprehension of arrest against the said FIR. 

The FIR was registered when the police received a complaint against the actress who was alleged to be the director of porn films. It was also claimed that she used to threaten, coerce and lure women with money to act in such movies, which was further released on the mobile application Newflix. 

Thus, the application for anticipatory bail filed by Gehna Vashisht was rejected by the Bombay High Court on September 7, 2021. 

Recently, famous businessman Raj Kundra who is also accused in another FIR with relation to a porn film case was granted bail by the Chief Metropolitan Magistrate at Esplanade, Mumbai on a surety of Rupees 50,000 with certain conditions.
