No Basic Affirmation Of Facts By UP Police': Karnataka HC On Notice To Twitter India MD In Ghaziabad FIR

The Hon’ble Karnataka High Court had lashed out at UP Police for insisting on the appearance of Twitter India’s Managing director that is Minish Maheshwari for investigation in the FIR concerning the Ghaziabad Video, without even ascertaining the basic facts about his and Twitter India’s culpability in the matter.

Hon’ble Justice G Narender noted that the crux of the matter is that a doctored video was uploaded on the Twitter platform, however, Twitter India cannot be connected with the alleged incident.

The Hon’ble court in this situation had passed an interim order on 24th June 2021 restraining Uttar Pradesh police from taking coercive action against Director Mahesh Maheshwari according to the notice issued to him under section 41A of the Code of Criminal Procedure, 1973 in the Ghaziabad FIR. This had been challenged by the UP Police in the Hon’ble Supreme Court.

The Hon’ble Supreme Court while granting interim relief, had permitted the police officers to record his statement through virtual mode.
