The India’s leading law firm Khaitan & Co successfully represented Bling Brands Private Limited, proprietor of the well-known fitness and wellness brand “BOLDFIT”, in a trademark infringement and passing off action before the Delhi High Court against a partnership concern operating under the name Bold Fitness.
Case Background
The suit was instituted against the Defendant for using deceptively similar marks “BOLD FITNESS” / “BOLDFITNESS” in relation to identical goods, namely gym and athleisure wear, thereby causing infringement and passing off of the Plaintiff’s registered and established trademarks.
Court’s Order
Upon hearing detailed submissions, the Court was pleased to grant an ex parte ad interim injunction in favour of the Plaintiff, restraining the Defendant from using the impugned marks. The Court further appointed a Local Commissioner to conduct search and seizure operations at the Defendant’s premises, ensuring immediate enforcement of the order.
