Beyond Judgements – 5th Episode: Justice Salil Kumar Rai Shares Insights on Advocacy, Judicial Responsibility, and Life Beyond the Bench at RPNLUP

Prayagraj, July 22, 2025: In the fifth episode of the ‘Beyond Judgements’ series, an esteemed initiative of Dr. Rajendra Prasad National Law University, Prayagraj (RPNLUP), students had the unique opportunity to engage in an insightful interaction with Hon’ble Mr. Justice Salil Kumar Rai, Judge, Allahabad High Court.

The distinguished series, launched under the visionary leadership of Hon’ble Vice-Chancellor Sr. Prof. (Dr.) Usha Tandon, aims to create a platform where law students can engage in meaningful conversations with eminent members of the judiciary beyond textbooks, statutes, and judicial precedents.

The session featured an engaging interaction with RPNLUP students Ms. Pratibha Gaur, Mr. Abhyuday Sharan, and Mr. Nishant Jadwani, who conversed with Justice Rai on various aspects of the legal profession and judicial functioning.

Reflecting on his journey into the legal profession, Justice Salil Kumar Rai described his path into law as one shaped gradually through perseverance and practical experience, rather than through a rigidly predetermined plan.

Speaking about his formative years at the Bar, His Lordship observed that young advocates rarely have the privilege of selecting their preferred area of practice at the beginning of their careers and must initially work on whatever matters come their way. He also emphasised the importance of having strong constitutional fundamentals for practice before the High Court.

From Advocacy to the Bench

Discussing the transition from advocacy to judicial office, Justice Rai acknowledged the profound transformation required in becoming a judge. He observed that a judge must impartially evaluate the rights and positions of all parties with fairness, equity, and neutrality.

The interaction offered students a deeper understanding of how judicial responsibility requires a shift from representing one side to ensuring justice for all parties before the Court.

Message for First-Generation Lawyers

Addressing the challenges faced by first-generation lawyers, Justice Rai rejected the notion that success in the legal profession depends upon family background.

His Lordship observed that hard work, honesty, consistency, and soft skills ultimately determine recognition in the profession. Describing law as a “marathon”, he remarked that although professional growth may be gradual, sustained effort and integrity always earn respect.

Simplicity and Clarity in Advocacy

Speaking on advocacy, Justice Salil Kumar Rai stressed that law is not merely about statutes and precedents, but equally about clarity, persuasion, and practical wisdom developed through experience.

He remarked that simplicity in presentation is often more effective than complicated arguments or high-sounding phrases. His observations served as an important reminder for young law students and aspiring advocates that effective advocacy lies in clear thinking and precise expression.

Importance of Dissenting Opinions

On the subject of judicial decision-making, Justice Rai recognised the significance of dissenting opinions in shaping constitutional jurisprudence.

His Lordship’s reflections highlighted how dissent plays a meaningful role in the development of legal principles and contributes to the continuing evolution of constitutional law.

Offering a glimpse into his life beyond the courtroom, Justice Salil Kumar Rai shared his fondness for reading and playing badminton with family members whenever time permits.
