
Trilegal Secures Delhi High Court Relief for TPG Software in Key Tax Appeal
Trilegal successfully represented TPG Software before the Delhi High Court in a significant transfer pricing appeal concerning the selection of comparable companies for transfer pricing analysis of a captive software development service provider.
The High Court allowed TPG’s appeal and intervened on the issue of comparable selection, holding that the Income-tax Appellate Tribunal’s order was perverse due to its failure to provide reasoned findings on the selection of comparables.
This ruling marks an important development in tax litigation, reinforcing the availability of a remedy before High Courts on questions of fact where findings are perverse or unreasoned.
