Meysan successfully represented one of Saudi Arabia’s largest banks in securing a landmark enforcement ruling in Kuwait, obtaining two court judgments enforcing execution orders issued by a Saudi enforcement judge against two Kuwaiti guarantors, with a combined value exceeding SAR 127 million.
This judicial success marks a major legal precedent in Kuwait, as it involved an unconventional application of the rules governing the enforcement of foreign judgments and orders. Unlike traditional foreign court judgments, execution orders differ in nature and legal requirements and have historically faced resistance within the Kuwaiti legal system.
The rulings are significant in affirming the flexibility of the Kuwaiti judiciary to recognize and give effect to foreign legal instruments such as execution orders. These instruments, while typically faster and simpler than full court judgments, often encounter more restrictive procedural treatment in many jurisdictions.
