
Khaitan & Co Represented Saregama India Limited in Copyright Dispute Regarding the Film “MASK”
The leading law firm in India, Khaitan & Co represented Saregama India Limited before the Delhi High Court in a copyright infringement suit against Madras Black Film and Ilaiyaraja regarding the use of the song “Naguva Nayana” in the film MASK.
The Delhi High Court clarified that Ilaiyaraja, as the music composer, has no right to grant any copyright license for the sound recording and restrained Black Madras Films from releasing MASK on OTT platforms without obtaining a copyright license from Saregama India Limited.
The Court also recognized that Ilaiyaraja, being only the music composer of the song, cannot grant any copyright license for the same.
