
Khaitan & Co advised Skechers USA Inc on Securing John Doe Order from Delhi High Court Against Counterfeit Sellers
Khaitan & Co advised Skechers USA Inc and Skechers USA Inc II, acting through Skechers South Asia Private Limited (‘Skechers’), in securing a John Doe order from the Delhi High Court amid increasing challenges posed by the widespread sale of counterfeit goods bearing the SKECHERS trademarks.
On 25 October 2024, the Court granted Skechers a John Doe order, enabling it to conduct search and seizure operations to combat the unlawful sale of counterfeit products. These operations were executed the very next day, on 26 October 2024, by the Skechers and Khaitan & Co. (‘KCO’) team, with the support of police authorities and appointed Local Commissioners.
Following months of surveillance, Skechers identified additional manufacturers and wholesalers involved in producing and distributing counterfeit Skechers merchandise, significantly damaging the brand’s goodwill and misleading consumers.
Skechers approached the Delhi High Court again on 28 April 2025 and received further relief against the newly identified counterfeiters. Acting swiftly, the Skechers and KCO team conducted search and seizure operations at six different locations on 3 May 2025, resulting in the seizure of over 1,800 pairs of counterfeit Skechers products, packaging boxes, unfinished raw materials, and printing blocks bearing the Skechers trademarks used for screen printing.
Skechers South Asia Private Limited & Ors were represented before the Delhi High Court by Mr. Chander M. Lall (Senior Counsel), along with Smriti Yadav (Partner), Nirupam Lodha (Partner), Kshitij Parashar (Principal Associate), Shubham Shende (Senior Associate), and Gautam Wadhwa (Senior Associate) from Khaitan & Co.
