Delhi High Court Recognises and Protects Hrithik Roshan’s Personality Rights, Orders Removal of Infringing Content

Mr. Hrithik Roshan, through DSK Legal, filed a suit before the Hon’ble Delhi High Court seeking, inter alia, a permanent injunction restraining the misappropriation of his personality and publicity rights, infringement of copyright and performer’s rights, acts of passing off and tarnishment, as well as reliefs of damages, rendition of accounts, delivery up, and other consequential reliefs. Mr. Roshan moved the Hon’ble Delhi High Court on the basis that his Personality and Publicity Rights are being violated.

Hearing Before the Court

The matter was listed before Her Ladyship Hon’ble Justice Manmeet Pritam Singh Arora, Hon’ble Delhi High Court, on October 15, 2025, for hearing of ad-interim/interim reliefs.

Claim of Exclusive Personality Rights

It was Mr. Roshan’s case that his Personality and attributes are uniquely identifiable only with him and he enjoys exclusive Personality Rights / Publicity Rights over all aspects of his Personality. The law acknowledges that a celebrity has exclusive authority over the commercial exploitation of his Personality. Accordingly, no person is entitled to utilize, misappropriate, imitate, or commercially exploit any facet of any celebrity/Personality without his consent or express authorization. Given his goodwill and reputation, he is exclusively entitled to commercially exploit his brand name ‘Hrithik Roshan’ and his attributes.

Court’s Examination and Interim Order

The Court carefully went through the list of URLs and posts submitted by Mr. Roshan, examining each entry individually. Upon careful examination, the Court determined that the entries contained material which infringed Mr. Hrithik Roshan’s personality rights, and warranted a take down, and accordingly passed an order in favour of Mr. Roshan, granting ad-interim protection in respect to the infringing material that the Court deemed to be infringing.
