Ashok Arora informs Delhi HC that issue of his removal from SCBA post referred to Committee of retired Judges for mediation

While the Delhi High Court was hearing Advocate Ashok Arora’s challenge to his removal from the post of Secretary of Supreme Court Bar Association (SCBA), he has informed the High Court that the issue has been referred to a Committee consisting of three retired Judges for mediation. He also informed the Court that the mediation is in progress and was pursuant to Resolution by SCBA dated August 29, 2020.
In spite of the mediation process, Arora pressed that the arguments on his stay application be heard.
The Court has adjourned the matter till September 25 and has sought a report in respect of the outcome of the mediation, if any.
Ashok Arora had called for an Emergent General Meeting in the month of May to remove Senior Advocate Dushyant Dave from the post of SCBA President following which the Executive Council of SCBA had suspended Arora from the position of the Secretary with immediate effect. Arora subsequently moved the High Court challenging the resolution.
Arora contended that his removal was void ab initio, as it was in violation of Rule 35 of the SCBA Rules.
On the last occasion, the Court had asked Arora and SCBA if they were open to mediation by a retired Supreme Court judge to settle their dispute.
