Trilegal Secures Trademark Protection for Education Today in “VASANT VALLEY” Dispute

High Court Decrees Suit in Terms of Settlement Agreement

The Hon’ble High Court secured Education Today’s rights in the trademark and decreed the suit in terms of a Settlement Agreement dated 12 May 2026 entered between Education Today and the Vasant Valley Concept School, Telangana.

As part of the decree, the Vasant Valley Concept School, Telangana, was directed to change its name and take down its website, social media handles, and advertisements on public platforms using the infringing mark. The school also undertook not to indulge in any act of infringement, passing off, and/or dilution of Education Today’s registered mark “VASANT VALLEY”.

Matter Overview

Trilegal acted for Education Today after it was informed of potential infringement of its trademark by other educational institutions. The firm advised initiating an investigation, which led to the discovery of unauthorised use of the mark “VASANT VALLEY” across domain names, websites, social media platforms such as Facebook, Instagram and YouTube, advertisement portals like JustDial, as well as goods, merchandise, banners and hoardings by Vasant Valley Concept School, Telangana.

Case Background

Trilegal filed a commercial suit before the Hon’ble Delhi High Court seeking permanent injunctive reliefs against the unauthorised use of Education Today’s registered trademark “VASANT VALLEY”.

Education Today has been using the mark since 1990 for operating Vasant Valley School, New Delhi, which has acquired significant reputation and goodwill. The defendant school, established in 2005, adopted a deceptively similar name, leading to alleged infringement and passing off.

Proceedings Before the Hon’ble Court

Trilegal secured results for Education Today in record time. On 05 May 2026, the suit came up for hearing for the first time before Justice Tushar Rao Gedela of the Hon’ble Delhi High Court.

After perusing the suit and considering the submissions made on behalf of Education Today, the Hon’ble Court observed that the Vasant Valley Concept School had been using a trademark deceptively similar to Education Today’s registered mark.

Pursuant to a proposal from the Vasant Valley Concept School, the Hon’ble Court permitted the parties to amicably discuss and mediate the disputes arising out of the alleged infringement.

Settlement Terms and Undertakings by Defendant

Trilegal drafted the settlement terms promptly, and after discussions at its office in New Delhi, the parties executed a Settlement Agreement on 12 May 2026.

As part of the settlement, the Vasant Valley Concept School agreed and undertook to change its name and remove Education Today’s registered mark from its branding and communications.

The defendant further undertook not to indulge in any act of infringement, passing off, and/or dilution of Education Today’s goodwill in the mark “VASANT VALLEY”.

The Vasant Valley Concept School also took down its website and YouTube page and undertook to remove its social media pages on Facebook, Instagram, and JustDial, and to file appropriate applications before the relevant state authorities to officially change its name.

As a gesture of good faith, Education Today did not pursue any claim for damages.

Decree of the Court

On 19 May 2026, the Hon’ble Delhi High Court decreed the suit in terms of the Settlement Agreement.

The Court also directed Meta Platforms Inc. and Just Dial Limited to ensure compliance with removal obligations in case of default by the defendant.

The defendant was further directed to file a compliance report by 10 July 2026.

The dispute was resolved within a fortnight.
