Khaitan & Co acted for Saregama India Limited in a copyright infringement suit concerning the alleged unauthorised exploitation of sound recordings from the film Moodu Pani. The dispute arose over claims relating to ownership and licensing rights of copyrighted works held by Saregama.

Proceedings Before the Court

The Division Bench of the Hon’ble Delhi High Court upheld the injunction earlier granted by the Single Judge, restraining Mr. Ilaiyaraaja and Vels Film International Limited from exploiting the copyrighted works of Saregama India Limited.

Court Findings

The Court observed that, in the absence of a valid licence or permission from Saregama India Limited, Vels Film International Limited could not have exploited any sound recordings contained in Moodu Pani, and Mr. Ilaiyaraaja could not have assigned such rights to Vels Film.

The Division Bench reaffirmed the findings of the Single Judge, holding that Saregama India Limited remains the owner of the copyrighted works forming the subject matter of the suit.
