Application for Inspection

The application for inspection (I.A. No. 8730/2026) was filed on behalf of Padmaja Kumari Parmar, Respondent No. 2 in TEST.CAS. 4/2026.

Objections Raised

The application was vehemently opposed on various grounds. Lakshyaraj’s counsel argued that the Will, being a registered document, carries a presumption of genuineness, and that being a public document, the same can be obtained from the Registrar, Udaipur.

It was also contended that since no formal notice had been issued to Padmaja, and since pleadings were not complete, no inspection of this document could be allowed either to counsel or to a handwriting expert.

Submissions on Behalf of Padmaja Kumari Parmar

The counsel for Padmaja submitted that the disputed Will had been challenged, the original of the said document needed to be examined, and this was a right that could not be denied. It was further submitted that the signatures on the alleged Will were not genuine.

After hearing the matter at length, the Court was inclined to allow the application. In view of the order for inspection being passed, the counsel for Lakshyaraj withdrew their objections to the application.

Court Directions

It was further agreed between the parties that neither Padmaja nor the handwriting/forensic expert would photograph the Will during the inspection, and that the name of the handwriting expert would be communicated to the counsel for the Petitioner at least one day prior to the inspection.

The order dated 04.05.2026 was passed by the Joint Registrar (Judicial), Dr. Jagminder Singh (DHJS). The inspection has accordingly been scheduled for 15.05.2026.
