The matter involved a challenge to the revised banking dispensation introduced pursuant to MERC’s Review Order, which had significant implications for solar power developers and open access consumers across Maharashtra.

Interim Relief Granted

By an interim order dated 27 April 2026, APTEL granted a stay on the revised banking dispensation, including the invoices issued thereunder. The Tribunal also restrained MSEDCL from taking any coercive action against the solar power developers and their open access consumers.

Significance

This interim relief marks a crucial development for Maharashtra’s renewable energy ecosystem, preserving the viability of banking as a foundational mechanism supporting solar energy and open access arrangements. As per MERC’s Review Order, nearly 30–40% of solar capacity in Maharashtra risked being stranded, making this relief particularly impactful for the sector.
