ITAT transfers BuckEye Trust case after Karnataka High Court indicates order was ‘AI-driven’
The judge had disposed of the matter stating it was a weird decision
The Bengaluru bench of the Income Tax Appellate Tribunal (ITAT) has reassigned a case to another bench after it emerged that the order passed by the previous bench was ‘AI-driven’.
The reassignment by the ITAT president followed an interim order by the Karnataka High Court in August on a writ petition from BuckEye Trust.
In September, Justice M Nagaprasanna of the Karnataka High Court had disposed of the case after recording what he termed “a very strange” instance.
In August, the court restrained the judicial member from hearing BuckEye’s case after its order appeared to be ‘AI-driven. The inference of the use of AI (artificial intelligence) to draft the order became evident after the ITAT bench recalled its order.
Thus, BuckEye approached the court seeking directions to ITAT to transfer the case to another bench.
Justice Nagaprasanna had allowed the tribunal to consider the petitioner’s request for a transfer to another bench. The court recorded the transfer and disposed of the case.
