Delhi High Court Restrains Ravi Mohan Studios from Using “BRO CODE” as Film Title, Upholds Indospirit’s Trademark Rights

The leading law firm in India, Khaitan & Co, successfully represented Indospirit Beverages Private Limited before the Delhi High Court, which has restrained Ravi Mohan Studios Private Limited from using the mark “BRO CODE” as the title of its upcoming film.

Background of the Case

The interim order was passed by Justice Tejas Karia in a trademark infringement suit filed by Indospirit Beverages, the manufacturer of the popular carbonated wine-in-a-pint beverage sold under the name BROCODE.

The Court held that the use of an identical mark for a film title was likely to cause confusion among consumers and dilute the goodwill and reputation associated with Indospirit’s flagship product.

“A prima facie case is made out by the Plaintiff (Indospirit) that the Plaintiff’s mark has been used in an identical manner in the title of the Defendant’s (Ravi Mohan Studios) film without any authorization, which amounts to infringement and is also likely to create confusion in the minds of consumers,” the Court stated in its order dated October 14, 2025.

Indospirit’s Trademark and Brand Presence

Indospirit launched its BROCODE beverage in 2015 and holds registered trademarks in multiple classes, including Classes 32 and 33 for alcoholic and non-alcoholic beverages. Over the years, BROCODE has become a well-known brand through strategic marketing, collaborations, and digital engagement.

In 2025, the company expanded into entertainment with BroCode Roast on YouTube, which attracted over 200 million views, and a music video titled BroCode: Onam Ulsavam Song.

Discovery of Infringement and Legal Action

In September 2025, Indospirit discovered that Ravi Mohan Studios was promoting a film titled BRO CODE. Despite multiple meetings, follow-up emails, and a cease-and-desist notice dated October 4, 2025, the studio allegedly continued using the contested mark.

Senior Advocate Chander M. Lall, representing Indospirit, argued that such unauthorized use amounted to trademark infringement and was an attempt to ride on the goodwill of the BROCODE brand.

Defence and Court’s Analysis

The production house argued that Indospirit lacked trademark registration in Class 41 (covering entertainment services) and that its pending application for BROCODE ROAST provided no enforceable right. The studio also relied on an October 3, 2025 Madras High Court injunction restraining Indospirit from issuing “groundless threats.”

Justice Karia, however, clarified that under Section 142(2) of the Trade Marks Act, 1999, an action for groundless threats ceases once a trademark infringement suit is filed. Therefore, the Madras High Court’s order would not prevent the Delhi High Court from granting relief.

Court’s Findings and Directions

The Court found that Indospirit’s BROCODE mark has a “strong and exclusive association” with the company. Using an identical title for a film was likely to cause confusion and irreparable harm to Indospirit’s goodwill.

Accordingly, the Court restrained Ravi Mohan Studios, its officers, and agents from:

using, adopting, reproducing, broadcasting, promoting, publishing, displaying, communicating, selling, offering for sale, or otherwise exploiting the BROCODE mark or any deceptively similar variant in connection with its upcoming film, trailer, teaser, poster, or social media content.

However, the Court clarified that the studio may continue film production, provided it complies with these directions.

The studio has been directed to file its reply within four weeks, with a rejoinder by Indospirit to follow. The next hearing is scheduled for December 23, 2025.
