The draft rules under the DPDP Act lay out a framework for various issues, including notice, cross-border transfers, children’s data, and the classification of Significant Data Fiduciaries, registration of consent managers — all of which could impact AI-driven businesses. These rules were highly anticipated, with the expectation that they would address implementation challenges, procedural gaps, and areas where the Act required further clarity. While the draft does attempt to cover some of these aspects, there is still significant ground to cover.
Globally too, laws are evolving:
a. The EU AI Act classifies AI systems by risk and imposes specific obligations on high-risk systems — especially those that process sensitive personal data.
b. OECD’s AI Principles and G7 Codes of Conduct are setting global ethical benchmarks.
c. The U.S., while lacking a federal privacy law, is seeing privacy protections emerge at the state level, which affects cross-border digital operations.
Legal teams must now not only interpret these evolving laws but guide internal teams to build systems that are future-ready.
CROSS-BORDER DATA FLOWS: A TIGHTENING LANDSCAPE
As AI models often rely on globally sourced data, and cloud infrastructure spans geographies, cross-border data transfers have become a central concern for privacy regulators. For AI companies operating internationally, navigating this regulatory mosaic is both critical and complex.

For legal teams, this means:
a. Reviewing data transfer arrangements across vendors and group entities
b. Including jurisdiction-specific safeguards in client contracts
c. Staying updated with bilateral frameworks and blacklisted regions
d. Ensuring compliance with data privacy standards set by regulatory authorities
e. Ensuring data localization requirements are met, where applicable
