
Khaitan & Co advised and successfully represented Saregama India Limited before the Bombay High Court
Khaitan & Co advised and successfully represented Saregama India Limited (“Saregama”) before the Bombay High Court in Notice of Motion No. 489 of 2017 filed by Mr. Rajesh Jhaveri, a notable music composer, director, and producer.
This is a landmark judgment on a Notice of Motion deciding key issues relating to copyright ownership and the term of assignment. While rejecting the Plaintiff’s claim for an injunction, the Court upheld Saregama’s position in line with the ruling in Rupali Shah vs Adani Wilmar (decided on 11 June 2025), where Khaitan also represented Saregama. The judgment clarified that, under the Copyright Act, 1957 (as amended in 2012), default in royalty payments alone cannot be a ground to rescind an assignment contract.
Although these findings are significant, they were made at a preliminary stage and the final determination will depend on a full evaluation of evidence during the trial.
