Trilegal Represented Springer Healthcare in Landmark Delhi High Court Reassessment Judgment
Trilegal successfully represented Springer Healthcare before the High Court of Delhi, which allowed the taxpayer’s writ petition and delivered a landmark ruling clarifying the scope and limitation period for reassessment proceedings under the Income Tax Act, 1961.
The judgment is particularly notable for being among the first to examine the interplay between audit objections as a source of ‘information’ and the doctrine of ‘change of opinion’ under the revised reassessment regime. The Court’s findings offer crucial protection to taxpayers by curbing the tendency to reopen assessments based solely on audit triggers.
The matter was led by Himanshu S. Sinha (Partner & Head of Tax Practice), with support from Prashant Meharchandani (Counsel) and Associates Kanupriya Sharma and Paras Arora.
