This intensive course delves into investor-state dispute settlement (ISDS) in international investment law, emphasizing arbitration’s role in resolving investment disputes and its effects on substantive standards and host states’ regulatory rights. It critically examines arbitral jurisprudence, addressing concerns from scholars, policymakers, and developing country governments. The course also explores recent trends in investment treaty-making and reform initiatives tackling these concerns.
